Christopher Smith, a formerly-prolific Make Penis Fast spammer, just got slapped with a $5.6M judgement in AOL's suit against him.

All an appeal will do is increase the legal bill -- the chance of overturning this judgement is just south of zero. Declaring bankruptcy just means AOL has to work harder. (Or does Michigan have a Florida-style overgenerous asset shield law?) They've got a great track record of successfully confiscating spammers' property post-judgement, including several expensive cars that they raffled off. Combining that with the perp's pending felony conviction for violating the Controlled Substances Act, I don't see bankruptcy buying him anything other than lots of additional pain for little gain.

As for insurance, wouldn't liability coverage normally exclude illegal acts commited with the knowledge of their illegality?
